North Dakota’s 2026 general judgment-interest rate is 10.00% under N.D.C.C. §28-20-34. For judgments entered on or after January 1, 2006, the annual rate is the prime rate published on the first Monday in December plus three points, rounded up to the next one-half percentage point. A rate stated in the original instrument can govern instead.
How North Dakota post-judgment interest works
Which rate applies
Section 28-20-34 uses the original instrument’s rate when one is stated; otherwise it supplies the annual statutory formula for post-2005 judgments. A distinct transition rule applies to judgments entered before January 1, 2006, so the current headline should not be back-applied to older judgments.
When interest accrues
North Dakota’s Supreme Court held in Orwig v. Orwig that §28-20-34 does not require a post-2005 judgment to keep its entry-year statutory rate in later years. The published annual rates can therefore apply by calendar year. Partial payments require the separate allocation rule in §28-20-36.
Compounding and rate lock
Section 28-20-34 bars compounding under the general statutory path. A general payoff calculator remains disabled because the original-instrument branch, pre-2006 transition, partial-payment sequence, and every special judgment path are not fully modeled.
