When Oklahoma prejudgment interest applies

Sharply restricted and split across two statutes. (1) 12 O.S. 727.1(E) authorizes prejudgment interest ONLY on a "verdict for damages by reason of personal injuries or injury to personal rights" (e.g., bodily restraint, personal insult, defamation, invasion of privacy, injury to personal relations) — accepted on/after Nov 1, 2009. It does NOT cover contract, property, or general commercial claims.

When it starts accruing

Depends on claim type. For personal-injury/personal-rights verdicts (12 O.S. 727.1(E)): accrual begins the date 24 MONTHS AFTER the suit resulting in the judgment was commenced (not the date of injury), running until verdict acceptance/judgment.

Simple or compound

Simple. Oklahoma prejudgment interest is computed as simple interest on the principal/verdict amount; the statute prescribes annual re-setting of the rate but does not compound accrued interest.

How the rate is set

Variable, reset annually. Prejudgment rate = average U.S. Treasury Bill rate of the preceding calendar year, certified by the State Treasurer per 12 O.S. 727.1(I) and published by the Administrative Director of the Courts. 2026 published prejudgment rate = 4.13%.
