When Alaska prejudgment interest applies

Prejudgment interest is a general remedy in Alaska and is NOT limited to liquidated or contract claims — it is recoverable on tort and unliquidated damages as compensation for loss of use of money. However, by statute AS 09.30.070(c), prejudgment interest may NOT be awarded on: (1) future economic damages, (2) future noneconomic damages, or (3) punitive damages. Where a written contract specifies an interest rate, that contract rate controls instead of the statutory rate.
