When Nevada prejudgment interest applies

Prejudgment interest in Nevada is generally limited to LIQUIDATED / readily ASCERTAINABLE sums. NRS 99.040 grants interest on: (a) contracts express or implied (other than book accounts); (b) settlement of book or store accounts from the day the balance is ascertained; (c) money received to the use/benefit of another and detained without consent; (d) unpaid wages/salary after demand. For OPEN/STORE accounts, interest may be awarded only by a court in an action on the debt (AG Op. 98-20).

When it starts accruing

Under NRS 17.130(2), interest on the money judgment (the prejudgment-to-postjudgment period) runs from the time of SERVICE OF THE SUMMONS AND COMPLAINT until satisfied — except any amount representing FUTURE damages, which draws interest only from entry of judgment.

How the rate is set

Variable formula, published by the Nevada Commissioner of Financial Institutions (Financial Institutions Division): rate = (prime rate at the largest bank in Nevada on the immediately preceding Jan 1 or Jul 1) + 2 percentage points. FID publishes the ascertained prime rate semiannually.
