When Michigan prejudgment interest applies

Michigan has NO separate general prejudgment-interest statute; instead MCL 600.6013 (nominally the "interest on money judgments" statute) runs interest FROM THE DATE THE COMPLAINT IS FILED, so the complaint-to-judgment portion functions as statutory prejudgment interest. It is available broadly and is NOT limited to liquidated/ascertainable claims — it applies to tort AND contract, and to unliquidated/tort damages (e.g., personal injury).

When it starts accruing

From the date the complaint is filed (for complaints filed on/after Jan 1, 1987) to the date of satisfaction of the judgment — MCL 600.6013(8). Exception for future damages: interest runs from filing only to the date of judgment (subsection (6)).

Simple or compound

Compound — compounded annually (MCL 600.6013(8); the written-instrument rate under (7) is also compounded annually).

How the rate is set

Variable, published by the Michigan State Treasurer. General/default rate = 1% + average 5-yr U.S. Treasury note auction yield for the preceding 6 months, re-certified each Jan 1 and Jul 1, compounded annually. Current (eff. 2026-01-01): 3.725% + 1% = 4.725%.

Prejudgment interest under MCL 600.6013 — 4.725%, compounded annually.
